Subject: It is a Nature Area not available for resedential development

It is my understanding that the land on which to so called Baja Sardinia development is proposed was found in a High Court judgement to be a Nature Area and, as such, not available for development. This finding has been fatal to previous development proposals and in the absence of any change, of which I am aware, in circumstances that alter the status of the area, that finding must apply equally to the present proposals.

There would seem to be a prerequisite for the present owners to show why development may be permitted in the Nature Area now whereas it was not permitted on past occasions. If this is so the Draft Scoping Study recently circulated by the would be developers seems to be a red herring which is diverting the attention of the public away from the crucial issue which is: whether the land is actually available for development at all.

People who oppose development of the Nature Area should be wary of palying the game that the would be developer is setting up and writing the rules and should not waste their energies on irrelevant issues. Opposition should focus on forcing the would be developer to show, as a first step, that the land is available for him to develop.

Hi there

The site has been set up for a platform for feelings as well as facts. The Developer appears to be pushing through a plan with the idea of hiding thier weakness, as stated in your post. Currently this is the only Public place for people to share thier disgust with this proposed development and long may they rant!

All objections have the following attached to their mail. It clearly sets out what your comments suggest:

'STATEMENT TO ACCOMPANY COMMENT ON THE BAJA SARDINIA SCOPING REPORT

I/we remain opposed to the use of the area being proposed for development in terms of the Baja Sardinia development proposal for any purpose inconsistent with its designation as a nature area and part of a buffer conservation zone between the urban edge of Langebaan and the West Coast National Park. I/we expect full compliance on the part of the Proposer of the Baja Sardinia development with Part 3 of regulations R 385 of the National Environmental Management Act, 1998 (Act 107 of 1998) (NEMA) relating to applications subject to scoping and environmental impact assessment. My/our comment on the scoping report can not be construed as acquiescence with, or support of the proposal or a process leading to the consideration of the proposal outside of the context of a comprehensive environmental management plan for the Greater Langebaan area such as provided for amongst others in Chapter 5 of NEMA and in keeping with South Africa’s obligations of custodianship in terms of the Ramsar Convention consistent with Chapter 6 of NEMA. I/we reserve all rights accordingly.'

We are also writing and talking to the powers that be about this very issue and pointing them in the correct direction.
